COZY CUBES TERMS OF SERVICE

1. INTRODUCTION

1.1 These Terms of Service ("Terms") govern your access to and use of the CozyCubes website at https://cozycubes.co, the CozyCubes Minecraft server, and any related services, forums, and features (collectively, the "Services").

1.2 The Services are operated by Cozy Entertainment LLC, a Virginia limited liability company ("CozyCubes", "we", "us", or "our").

1.3 By creating an account on the website, linking your Discord account, submitting a whitelist application, accessing the Minecraft server, using the CozyCubes Discord server in connection with the Services, or otherwise using the Services, you agree to be bound by these Terms and all other policies referenced in them, including our Privacy Policy and any posted community or server rules ("Community Rules"). If you do not agree to these Terms, you must not use the Services.

1.4 We may revise these Terms from time to time. When we do, we will update the "Effective Date" above and may provide additional notice where required by law. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.

1.5 You should review these Terms regularly. If you do not agree with any updated Terms, you must stop using the Services.

2. ELIGIBILITY AND ACCOUNTS

2.1 Minimum age. You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2.2 Authority. By using the Services, you represent and warrant that:
(a) you meet the minimum age requirement in Section 2.1; and
(b) if you are using the Services on behalf of another person or entity, you are authorized to bind that person or entity to these Terms.

2.3 Accounts. To access certain features, including submitting whitelist applications and participating on the server, you must create an account on the website and link a valid Discord account as instructed. Your account and Discord link are personal to you and must not be shared, sold, or transferred.

2.4 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, you must notify us promptly at operations@cozycubes.co.

2.5 Refusal and termination. We may refuse registration, suspend an account, remove whitelist status, or revoke access to any or all of the Services where we reasonably believe these Terms, our Community Rules, or applicable law have been violated, or where necessary to protect other users, our infrastructure, or third parties.

3. WHITELIST APPLICATIONS AND SERVER ACCESS

3.1 Whitelisted server. Access to the CozyCubes Minecraft server is whitelisted. To be considered for access, you must:
(a) create a website account;
(b) link your Discord account; and
(c) submit a whitelist application through the website.

3.2 No guarantee. Submission of a whitelist application does not guarantee approval or continued access. Approval, denial, and revocation of whitelist status are in our sole discretion, based on our Community Rules, technical needs, and overall community welfare.

3.3 Changes to server and worlds. We may reset, modify, or discontinue worlds, maps, plugins, game modes, or other in‑game content at any time, including wipes or rollbacks, without compensation or liability for any resulting loss of progress, items, builds, or data.

3.4 Bans and moderation actions. We may issue warnings, mutes, kicks, temporary suspensions, or permanent bans for violations of these Terms, our Community Rules, or applicable law, or where we reasonably believe your conduct threatens the community or the operation of the Services. Moderation decisions are final and may be taken without advance notice.

4. COMMUNITY RULES AND PROHIBITED CONDUCT

4.1 Community Rules. CozyCubes is intended to be a cozy, inclusive community. You must comply with all Community Rules posted on the website, Discord, or within the server, as updated from time to time. In the event of any conflict between these Terms and Community Rules, these Terms will control to the extent of the conflict.

4.2 Prohibited conduct. Without limiting the Community Rules, you must not:

(a) harass, threaten, stalk, or abuse other users;
(b) engage in hate speech or discrimination, including content that is racist, sexist, homophobic, transphobic, or otherwise abusive;
(c) use cheats, hacked clients, exploits, macros, bots, or other tools that provide unfair advantages or disrupt the server;
(d) grief, steal from, or intentionally destroy other players’ builds or assets except where explicitly allowed by the relevant game mode or event rules;
(e) impersonate staff or other players, or falsely claim affiliation with CozyCubes or Cozy Entertainment LLC;
(f) upload, post, or share content that infringes any copyright, trademark, privacy, publicity, or other proprietary rights of any person;
(g) attempt to gain unauthorized access to the server, other accounts, or any network or systems related to the Services;
(h) use the Services for any unlawful, fraudulent, or malicious purpose; or
(i) circumvent or attempt to circumvent any technical, security, or enforcement measures we implement.

4.3 Consequences. Violations of this Section 4 or the Community Rules may result in enforcement actions as described in Sections 3.4 and 13, including bans and removal of access without refund.

5. VIRTUAL ITEMS, STORE PURCHASES, AND TEBEX

5.1 Tebex webstore. CozyCubes may offer cosmetic items, ranks, or other virtual benefits (collectively, "Virtual Items") through a webstore operated and processed by Tebex Limited ("Tebex").

5.2 Merchant of record. All purchases of Virtual Items are made from Tebex, not from CozyCubes. When you purchase a Virtual Item through the CozyCubes webstore, your purchase contract is solely with Tebex, which acts as the merchant of record for those transactions in accordance with Tebex’s own terms and conditions. CozyCubes does not sell Virtual Items directly to you.

5.3 Tebex terms. Your payments and any related refund, chargeback, or statutory rights are governed by Tebex’s terms and policies, currently available at:

You must review and agree to Tebex’s terms before making any purchase. CozyCubes is not responsible for and does not control Tebex’s decisions regarding refunds, chargebacks, or billing disputes.

5.4 Delivery of in‑game benefits. Upon notification from Tebex of a successful transaction, CozyCubes is responsible for applying the corresponding Virtual Items or in‑game entitlements to the appropriate Minecraft account on the CozyCubes server, subject to technical limitations and server availability. We are not responsible for delays or failures caused by outages, maintenance, or events beyond our reasonable control.

5.5 No cash value; no additional refunds from CozyCubes. Virtual Items have no cash value, are not legal tender, and cannot be exchanged, redeemed, or refunded for money or any monetary equivalent. Server bans, resets, modifications, or permanent closure do not entitle you to any additional refund or compensation from CozyCubes. Any refund, withdrawal, or chargeback entitlement you may have arises, if at all, under Tebex’s terms and applicable law and must be pursued directly with Tebex.

5.6 Age for purchases. Tebex’s terms specify minimum age requirements for purchasing Products via the Tebex checkout. You must not use the CozyCubes store if you are under the minimum age set by Tebex. If you are a minor but old enough to purchase under Tebex’s terms, you should only make purchases with the permission of a parent or legal guardian.

5.7 Changes to Virtual Items. We may change, rebalance, or discontinue Virtual Items at any time. If a Virtual Item is permanently discontinued, we may, but are not required to, offer replacement benefits or credits.

6. USER CONTENT AND LICENSE

6.1 User Content. "User Content" means any content you submit, upload, transmit, or display in connection with the Services, including builds, screenshots, chat messages, whitelist applications, forum posts, and other materials.

6.2 Ownership. You retain ownership of your User Content, subject to any third‑party rights.

6.3 License to CozyCubes. By providing User Content, you grant CozyCubes a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and create derivative works from your User Content in connection with operating, promoting, and improving the Services, and in community‑facing materials such as screenshots, trailers, and social media posts.

6.4 Representations. You represent and warrant that:
(a) you have all rights necessary to grant the license in Section 6.3; and
(b) your User Content does not violate these Terms, the Community Rules, or any third‑party rights.

6.5 Moderation of User Content. We do not undertake to monitor all User Content but reserve the right, in our sole discretion, to remove, edit, or restrict access to any User Content at any time where we reasonably believe it violates these Terms, the Community Rules, or applicable law, or where necessary to protect other users or the Services.

7. THIRD‑PARTY SERVICES (MOJANG/MICROSOFT, DISCORD, TEBEX, ETC.)

7.1 Third‑party platforms. The Services rely on or interoperate with third‑party platforms and services such as Mojang/Microsoft (Minecraft), Discord, Tebex, hosting providers, and other infrastructure or integrations (collectively, "Third‑Party Services").

7.2 Third‑party terms. Your use of Third‑Party Services is governed by their own terms and policies, not these Terms. We are not responsible for any acts or omissions of Third‑Party Services, including outages, changes in functionality, or enforcement of their own terms.

7.3 Effects on access. Suspension or termination of your accounts with Third‑Party Services (for example, your Discord or Mojang/Microsoft accounts) may affect your ability to use the Services. We are not responsible for any resulting loss of access or data.

8. AVAILABILITY, MAINTENANCE, AND CHANGES

8.1 No guarantee of uptime. The Services are provided on an "as available" basis. We do not guarantee that the website, Discord integrations, or Minecraft server will be available at all times or without interruption.

8.2 Maintenance and downtime. We may suspend or limit access to any part of the Services for maintenance, security, legal, or operational reasons, with or without notice.

8.3 Changes to Services. We may change or discontinue any aspect of the Services, including features, game modes, plugins, worlds, or integrations, at any time.

9. DISCLAIMERS

9.1 "As is" and "as available." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

9.2 No guarantee of results. We do not warrant that the Services will be uninterrupted, secure, or error‑free, that defects will be corrected, or that any particular gameplay experience, world, or feature will be available at any given time.

9.3 Third‑party services. Because Minecraft, Mojang/Microsoft services, Discord, Tebex, and other Third‑Party Services are outside our control, we make no warranties regarding their availability, performance, or compliance with their own terms.

10. LIMITATION OF LIABILITY

10.1 Exclusion of certain damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COZYCUBES OR ITS OWNERS, MEMBERS, MANAGERS, STAFF, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Cap on liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNTS YOU HAVE PAID TO COZYCUBES (EXCLUDING PAYMENTS MADE TO OR RETAINED BY TEBEX AS MERCHANT OF RECORD) IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(b) FIFTY U.S. DOLLARS (USD $50).

10.3 Tebex purchases. For the avoidance of doubt, CozyCubes is not a party to your purchase contract with Tebex for any products acquired via the CozyCubes webstore and is not liable for any loss, damage, or statutory claim arising from that purchase, beyond CozyCubes’ separate obligations under these Terms to apply corresponding in‑game benefits where technically feasible.

10.4 Jurisdictional limits. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, the limitations above apply only to the extent permitted by law.

11. INDEMNIFICATION

11.1 You agree to indemnify, defend, and hold harmless CozyCubes, its owners, members, managers, staff, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
(a) your use of the Services;
(b) your violation of these Terms or the Community Rules; or
(c) your violation of any third‑party rights, including intellectual property or privacy rights.

12. GOVERNING LAW AND VENUE

12.1 Governing law. These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Commonwealth of Virginia, without regard to its conflict‑of‑laws rules.

12.2 Venue. You agree that any legal action or proceeding arising out of or relating to the Services shall be brought exclusively in the state courts located in or serving Richmond, Virginia, or the federal courts serving that jurisdiction, and you consent to the personal jurisdiction and venue of such courts.

13. TERMINATION

13.1 Your termination. You may stop using the Services at any time. You may request closure or deletion of your account as described in our Privacy Policy.

13.2 Our termination. We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms, the Community Rules, or applicable law, or if your continued access would present risk to the community, the Services, or third parties.

13.3 Effect of termination. Upon termination, your right to use the Services will end, and you may lose access to your account, whitelist status, and any Virtual Items or in‑game progress. Sections 4–12 and 14, together with any other provisions that by their nature should survive, will continue in effect after termination.

14. MISCELLANEOUS

14.1 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

14.2 No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of such right or provision.

14.3 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

14.4 Entire agreement. These Terms, together with the Privacy Policy and any Community Rules referenced herein, constitute the entire agreement between you and CozyCubes regarding the Services and supersede any prior or contemporaneous understandings.
